Terms of Service
These terms govern your use of DomainCashOffers.com and any submission, offer, or transaction made through it. By submitting a domain, you agree to them. Advancing Development ("we," "us") operates this service.
1. Submissions and offers
- Submitting a domain is a request for an offer, not a contract of sale. We may decline to make an offer on any submission, for any reason, without explanation.
- Offers we send are firm but time-limited: unless stated otherwise, each offer expires 48 hours after it is sent. An expired offer is void; we may or may not reissue it.
- An accepted offer becomes binding when both parties enter the Escrow.com transaction we open for it.
2. Your representations
By submitting a domain, you represent and warrant that:
- You are the registrant of the domain or have full legal authority to sell it.
- The domain is not stolen, hijacked, subject to a dispute, lien, UDRP or court proceeding, or registered in bad faith with respect to any third party's trademark.
- All information you submit is accurate.
We may require verification of control (for example, a DNS TXT record or an email sent from an address at the domain) before funding escrow, and may cancel any transaction where verification fails.
3. Trademarks
We do not knowingly purchase domains that infringe third-party trademarks, and we may decline or cancel any transaction involving a name we judge to carry trademark risk. This judgment is ours alone and implies no legal opinion about the name.
4. Payment
All purchases settle through Escrow.com. We pay all escrow fees. Escrow.com's own terms govern the escrow transaction itself. We never ask sellers to transfer a domain before an escrow transaction is opened and funded, and you should refuse any such request from anyone claiming to represent us.
5. No advisory relationship
Nothing on this site is an appraisal, investment advice, or a representation of any domain's market value. Our offers reflect what we are willing to pay, nothing more.
6. Limitation of liability
To the maximum extent permitted by law, our total liability arising from your use of this site or any transaction is limited to the amount we agreed to pay you in that transaction. We are not liable for indirect, incidental, or consequential damages.
7. Governing law
These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in Denver, Colorado.
